50-DAY HOME TRIAL
Terms and Conditions

Participating Models:

The Trial is applicable to the following FOTILE range hood models: JQG7505, JQG7505-W, JQG9006, and JQG9006-W.

Trial Timeframe:

50 Days. The day the product is delivered to the customer’s house is considered Day 1. The Trial ends 50 days from the delivery day.

Trial Rules:

• Customer’s registration:
  Customers register on the Program webpage to express their interest in participating in the Trial. Customer must be at least eighteen (18) years old to participate in the Program.
• End User Only:
  The Trial is only available to customers who will use the product for personal, household and family use. Accordingly, customer acknowledge that
  (1) the product purchased through Trial is not intended for resale,
  (2) he or she is not ordering the product with the intention of reselling such product, and
  (3) he or she is not acting on behalf of any person or entity that intends to resell the product.
  If FOTILE reasonably determines that customer is in the business of reselling FOTILE products, then in addition to any other remedies available, FOTILE may terminate the Trial early and charge the customer for the full purchase price of the product at FOTILE’s sole discretion.
• FOTILE’s Selection Process:
  FOTILE Team will contact customers to confirm that their kitchen setup is eligible for installing the participating products. Participants will be chosen based on various criteria, including but not limited to geographic location, product availability, and the suitability of the customer’s kitchen environment.
• Selected Participants:
  Selected participants will be notified and provided with a designated Trial Link to place an order. By placing the order through the Trial Link, customers agree to the participation of the Trial, this Terms and Conditions and Privacy Notice, as well as all other applicable terms, conditions, policies, limitations and requirements. If, and then only to the extent that, other applicable terms are inconsistent with this Terms and Conditions, this Terms and Conditions will control only with respect to this Trial. 
  
  This Trial eligibility is non-transferrable to any other person or entity.
• Payment:
  Upon placing an order, customer will be asked to fill in the payment method details and authorize FOTILE to charge the amounts owed by customer for the Trial product. If clients choose credit cards as their payment method, it is required that the card’s expiration date be at least 90 days in the future. A "pending transaction" will be shown on their bank account statements, but customers will not be charged at the moment.
  
  If FOTILE is not able to charge any amounts owed by customer under these Terms and Conditions to the payment method on file, FOTILE reserves the right to pursue any remedy that is available.
• Delivery:
  The Trial starts on the day the product is delivered. During the Trial period, customers are encouraged to fully test the product by using it daily.
• Purchase:
  If the customers decide to keep the product, or fail to contact FOTILE customer support before the Trial ends to initiate the return, the payment will be automatically processed at the end of the Trial. Customers agree to pay the full purchase price and are responsible to ensure the provided payment method is valid and has sufficient funds.
• Return:
  If the customers are not satisfied with the product, they are obligated to contact FOTILE customer support to initiate the return process before the Trial ends and follow the return instruction and return policy. Customers must ensure the product is in good condition without damage and is securely packed in its original packaging. When FOTILE receives the return, FOTILE will determine in its sole discretion if the product is in good condition. If the return product is determined by FOTILE to not be in a good condition, FOTILE may in its sole discretion charge customer the purchase price.
  
  Customer will not incur any return shipping costs. FOTILE will provide a return shipping label, and customer shall return the product within seven (7) days of receiving this label. If customer fails to return the product in time pursuant to the return policy, FOTILE may in its sole discretion charge customer the purchase price.
• Installations and Uninstallations:
  a) FOTILE does not cover installation costs.
  b) Customers are responsible for uninstalling the old unit at their residence and installing the new product, including any associated costs. In the event of a return, the product must be sent back in its original packaging; thus, customers are advised to retain the original FOTILE product packaging and their old product.
  c) Customers are responsible for uninstalling the new FOTILE product, including any associated costs, if they decide to return before the Trial ends.
• Warranty:
  Trial participants are entitled to the same product warranty as those who make regular purchases. The warranty period begins on the delivery date of the product.

• Title and Risk of Loss:
  Title to each product in the Trial remains with FOTILE until the Trial ends and the purchase price has been collected by FOTILE. 
  
  Risk of loss passes to the customer upon delivery of the product to the carrier. For returns from customer to FOTILE, risk of loss passes to FOTILE upon our receipt of the return product from the carrier.
• Governing Law, Disputes Resolution:
  All matters arising out of or relating to this Trial and Terms and Conditions are governed by and construed in accordance with the laws of the state of New Jersey without giving effect to any choice of or conflict of law provision or rule (whether of the state of New Jersey of any other jurisdiction) that would cause the application of laws of any jurisdiction other than those of the state of New Jersey.
  
  Any dispute or claim arising from or relating to the Trial or these terms and Conditions is subject to the binding arbitration, administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules which shall take place in New Jersey. The arbitrator’s award shall be final and judgment may be entered upon it by any court having jurisdiction within the state of New Jersey.
• Product Improvement and Marketing:
  a) FOTILE may contact customers for feedback regarding product improvement and marketing purposes. Customers may be asked one or a combination of things. The list includes but is not limited to product surveys, customer experience, images or videos, social media posts, onsite visits, or interviews.
  b) Customers reserve the right to decline these requests.
• Limitation of Liability:
  a) FOTILE is not responsible for any damage or injury arising out of or in connection with the Trial. FOTILE is not responsible for any loss, damage, or injury occurred during installation and uninstallation, or resulted from the misuse, mishandling, modification, or improper installation of the product.
  b) FOTILE assumes no responsibility for the compatibility of the product with other appliances or equipment installed in the customer's home.
• Privacy Policy:
  By participating in the Trial, customer understands and agrees it may be necessary for FOTILE to collect, process, transmit, maintain, and use certain of customer’s personal information, such as name, address, and information related to the payment method, to perform the service and support obligation under the Trial. At all times, FOTILE will treat customer’s information in accordance with FOTILE Privacy Policy, available at

• Severability:
  If any provision or part of any provision of these Terms is found to be illegal, invalid or unenforceable under any applicable law, such terms shall, insofar as it is severable from the remaining terms, be deemed omitted from these Terms and shall in no way affect the legality, validity or enforceability of the remaining terms.
• Disclaimers:
  a) FOTILE will limit the number of participants in the Program and may close registration at any time without prior notice.
  b) FOTILE holds the sole decision right to select registered participants for the Program. FOTILE reserves the right to refuse the Trial and/or suspend or terminate a customer’s Trial for any reason, including for order or returns behavior or if FOTILE believes such customer has violated or acted inconsistently with the spirit of these Terms and Conditions.
  c) FOTILE reserves the right to modify any aspect of the Trial or terminate the Trial at any time without prior notice.
  d) FOTILE may in its sole discretion change these Terms and Conditions. Customer’s continued use of the Trial after the effective date of the revised Terms and Conditions constitutes customer’s acceptance of the terms. If any change is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or Terms and Conditions.
  e) FOTILE reserves the right to take legal action against participants with invalid or failed payment. 
  f) By providing images and videos, customers grant FOTILE the right to use them for marketing purposes, sources will be kept confidential.

Additional Bonuses:

Installation Rebate:

Trial Participants who take a photo of their kitchen with FOTILE product installed and share in social media, will get $150 installation rebate.

Details:
  • Social media includes but is not limited to: Facebook, Instagram, WhatsApp Group, TikTok.
  • Participants need to:
    1. take a photo of their kitchen or cooking area with newly installed FOTILE product;
    2. share in social media and mention FOTILE;
    3. take a screenshot.
  • A link will be provided via email for participants to upload screenshot proof.
  • Rebates will be given in the form of Visa eGift Cards.

Referral Reward:

1. Trial participant who refers a friend to make a purchase at FOTILE’s official website will receive a rebate on their trial item:
   • 1 successful referral: 30% off trial price.
   • 2 successful referrals: 60% off trial price.
   • 3 successful referrals: FREE product.

2. Referees will get an additional $50 OFF on their purchase.

Details:
    Referral Process: Referrals must be made using the unique referral coupon code provided to the trial participant. Referrals made through other channels will not be eligible for rewards.

    Reward Redemption: Rebates earned through referrals will be processed in the form of refund after trial participant’s payment.

    Referral Validity: To qualify for the referral reward, referred friends must successfully complete their purchase on FOTILE’s official website.

    Fraudulent Referrals: FOTILE reserves the right to withhold referral rewards in case of suspected fraudulent or abusive referral activity.

    Modification of Terms: FOTILE reserves the right to modify or terminate the referral reward at any time without prior notice.
